Terms & Conditions

These terms apply to all sales by First Corporate Clothing LTD to the exclusion of any other terms unless otherwise agreed in writing. We reserve the right or reasons of continuous improvement to make changes to the items shown in this catalogue and to remove selected styles.

Price

The price of the goods will be the price ruling at the date of dispatch. All prices quotes  exclude postage and packing and VAT. Any applicable postage and packaging and VAT is payable by you in addition to the contract price

Delivery

It is the policy of First Corporate Clothing LTD to deliver all orders in full. Part deliveries will only be made at the request of the customer who will be liable for any additional carriage charges incurred. Shortages and damaged items within a delivery must be reported to us in writing within 3 days of receipt of delivery. The report should state the relevant order and delivery note numbers and the date on which the delivery was received. Our liability in respect of any such claims is limited to the replacement of the goods or refund of the price, at our option, and does not extend to any indirect or consequential loss.

You must pay our reasonable extra charges in respect of (a) any special arrangements made at your request to expedite delivery and (b) any costs, expenses and liabilities we may incur because of inadequate or incorrect delivery instructions. We aim to despatch all stock items within 5-10 working days from receipt of order. We aim to delivery special sized garments within 8 weeks.

Payment

Invoices will be issued on the day of the despatch of goods and must be paid within thirty days of invoice date, subject to status. If you fail to pay us on the dye date we may suspend or cancel future deliveries. Interest on any overdue account is payable at the rate equivalent to that set for the purposes of Section 6 of the Late Payment of Commercial Debts Act 1998.

Risk and ownership

The risk in the goods passes to you when the goods are delivered to the delivery address. Ownership of the goods remains with First Corporate Clothing LTD until payment has been received in full for the goods and any other garments for which payment is also due.

Insolvency

Despite any agreed credit terms all payments for goods supplied whether or not invoiced, become immediately due if (a) you make any voluntary arrangement with your creditors or become bankrupt or become subject to an administration order, (b) go into liquidation whether voluntarily or by order of the court; or (c) cease or threaten to cease to carry on business or First Corporate Clothing LTD reasonably believes any of the above events are about to occur and notifies you accordingly; then you must cease at one to use any of our goods not paid the and must when requested return to us any of the goods remaining in your possession.

Force Majeure

Where we are unable to perform due to any circumstances beyond our control we may suspend operations while those circumstances subsist and any agreed date or period for delivery shall be regarded as extended accordingly.

Returns Policy

If any catalogue garments are not required for any reason we will be happy to replace them or to refund their value provided they are (a) not personalised, (b) returned to us carriage paid unused within 30 days, (c) our invoice in relation to the item has been paid by the due date and (d) a completed return note is completed quoting the invoice number, style details and reason for return. This returns policy does not apply to non catalogue styles, garments made to customers special size requirements, altered or personalised garments

Limitation of Liability

If any faulty goods are returned First Corporate Clothing shall replace the goods free of charge, rectify the fault, or refund the price of the goods and First Corporate Clothing will have no further liability.  For any sales covered by the Consumer Protection (Distance Selling) Regulations 2000 the customer has a right to request a refund. First Corporate Clothing shall not be liable for any loss or damage whether direct or consequential or otherwise but in any event First Corporate Clothing (if any) shall be limited to the price of the goods. Nothing in these terms affects our liability for death or personal injury resulting from First Corporate Clothing Ltd negligence.

Samples

Samples will be invoiced to you on despatch and will be credited in full provided they are returned to us unused with 30 days of delivery, otherwise the price, including the carriage and VAT becomes payable immediately

English Law

This contract shall be governed by and construed and interpreted in accordance with English Law and shall be subject to the exclusive jurisdiction of the English Courts. Every effort has been made to ensure that the information in this catalogue is correct. However we have policy of continuously developing and improving our products and reserve the right to change specification without notice.
